1.1 Purpose

This DMCA Policy outlines Yamazaki Clan's procedures for handling claims of copyright infringement in compliance with the Digital Millennium Copyright Act (17 U.S.C. § 512) and similar international laws.

1.2 Scope

Applies to all Yamazaki Clan Services: website (yamazaki-clan.com), Discord server, Roblox group, social media accounts, and any affiliated platforms where user-generated content may appear.

1.3 Respect for IP

We respect intellectual property rights. We do not knowingly host infringing content. We respond promptly to valid notifications. This policy protects both rights holders and our community.

2.2 Availability

Agent available 24/7 via Discord. Email responses within 48 hours. Discord DM responses typically within 4 hours during active hours (UTC+9).

2.3 Registration

Agent registered with U.S. Copyright Office per 17 U.S.C. § 512(c)(2). Registration number available upon request.

3.1 Requirements (17 U.S.C. § 512(c)(3))

A valid notice MUST include ALL of the following:

• Physical or electronic signature of copyright owner or authorized agent
• Identification of the copyrighted work claimed infringed (or representative list)
• Identification of the infringing material AND information reasonably sufficient to locate it (URLs, message IDs, timestamps, screenshots)
• Contact information: name, address, phone, email of complaining party
• Statement of good faith belief that use is not authorized by owner, agent, or law
• Statement under penalty of perjury that information is accurate and you are authorized to act

3.2 Preferred Format

Email to dmca@yamazaki-clan.com with subject: "DMCA NOTICE - [Your Name/Company] - [Date]". Include all Section 3.1 items in body. Attach supporting docs (registration certificates, screenshots).

3.3 Discord Alternative

DM any Council member with "DMCA NOTICE" in first line. Provide all required info. We will confirm receipt and request email for formal record.

3.4 Incomplete Notices

We will notify you of deficiencies within 48 hours. You have 10 business days to cure. Uncured notices treated as invalid.

4.1 Timeline

Acknowledge receipt: 24 hours. Evaluate validity: 48 hours. Take action: 72 hours maximum from valid notice. Notify affected user: 24 hours after action.

4.2 Actions Taken

Remove or disable access to allegedly infringing Material. Notify the user who posted it (with notice copy, minus your contact info if requested). Terminate repeat infringers per Section 8.

4.3 Discord-Specific

Delete infringing messages/files. Ban user if repeat infringer. Report to Discord Trust & Safety if warranted. Preserve evidence for 90 days.

4.4 Roblox-Specific

Report infringing group assets (emblems, uniforms, place files) to Roblox via their IP form. Remove from clan group. Cannot directly delete user's personal Roblox assets.

4.5 Website-Specific

Remove from yamazaki-clan.com. Purge from CDN cache. Return 404/410 for removed URLs. Update sitemap.

5.1 Right to Counter-Notify

If your content was removed, you may submit a counter-notification if you believe: Removal was mistake/misidentification, OR You have valid license/fair use/public domain claim.

5.2 Counter-Notice Requirements (17 U.S.C. § 512(g)(3))

MUST include: Your signature. Identification of removed material + original location. Statement under penalty of perjury of good faith belief of mistake/misidentification. Your name, address, phone, email. Consent to jurisdiction of your local federal court (or Tokyo/JPN if non-US). Consent to accept service from original complainant.

5.3 Process

Submit to dmca@yamazaki-clan.com or Council DM. We forward to original complainant within 24 hours. Content restored in 10-14 business days UNLESS complainant files lawsuit and notifies us.

5.4 False Counter-Notices

Perjury penalties apply. We may terminate accounts for fraudulent counter-notices. Report to authorities if warranted.

6.1 Definition

A "repeat infringer" is any user with 3+ valid DMCA takedowns within 24 months, OR 1+ takedown for commercial-scale infringement, OR Court adjudication of infringement.

6.2 Consequences

Permanent ban from all Yamazaki Clan Services. Discord: Ban + report to Discord T&S. Roblox: Group ban + report to Roblox. Website: IP/device block. Blacklist shared with allied clans.

6.3 Appeals

Repeat infringers may appeal ONCE after 1 year. Must prove: All claims resolved/retracted, Legal license obtained for all disputed works, Changed behavior evidence. Council decision final.

7.1 Fair Use Considered

We evaluate fair use (17 U.S.C. § 107) before action: Purpose (transformative? educational? commentary?), Nature of work, Amount used, Market effect. Clan context: guides, critiques, parodies, news reporting more likely fair use.

7.2 Common Clan Scenarios

7.3 Guidance for Members

Create original content. Credit sources. Use minimal necessary portions. Add commentary/transformation. When in doubt, ask #support-ticket before posting.

8.1 Clan-Owned IP

Yamazaki Clan owns: Clan name "Yamazaki Clan", Emblem/Logo (shield design), Rank names/titles (Genin→Clan Master), Honor Point system design, Uniform designs (Gakuran variants), Lore/written backstory, Custom Discord emojis/badges, Website design/code.

8.2 Licensing

Members granted: Personal non-commercial use of clan emblems on profiles/avatars. Sharing clan media with credit. Creating fan art (non-commercial). NOT granted: Commercial use. Modifying official assets. Claiming ownership. Sublicensing.

8.3 Enforcement

Unauthorized commercial use = DMCA + cease & desist. Impersonation = Tier 4 expulsion + legal action. Asset theft = Roblox/Discord reports + legal.

9.1 EU / GDPR

eCommerce Directive Art 14 compliance. Notice-and-action procedures. Data subject rights respected in DMCA process.

9.2 UK

Copyright, Designs and Patents Act 1988. E-Commerce Regulations 2002. Same DMCA-equivalent process.

9.3 Japan

Japanese Copyright Act. Provider liability limitations. We honor Japanese takedown requests per local law.

9.4 Other Jurisdictions

We comply with valid court orders from any jurisdiction where we operate. Process adapted per local requirements.

10.1 17 U.S.C. § 512(f)

Knowingly materially misrepresenting infringement = liable for damages, costs, attorneys' fees. Includes false notices AND false counter-notices.

10.2 Our Response to Abuse

We track abusive notices. Pattern of abuse = report to authorities, block sender, legal action for damages.

11.1 Updates

Policy updated as law evolves. Material changes: 30-day notice via Discord #announcements. Version history in #clan-council.
